If you are behind on your mortgage and you know that you have your company bonus coming to you in a couple months, meet with a foreclosure attorney to see if you can get an extension on the payments you are behind. This may be the only way you can stop the foreclosure process and get ahead on your mortgage. There are some things you want to gather with you before you go to meet with your lawyer so they can quickly asses the case.

Proof of Bonus

You have to prove that the money will be coming to you. Meet with your employer or your office staff and ask them if they can get a document with the following information:

  • The amount you have coming, or what you already have earned for your commission bonus
  • When the payment is coming
  • Permission to release the bonus to the mortgage company

With that information your lawyer can see if the bonus will be enough to save your mortgage and if the bank will be willing to cooperate and agree to defer the payments. If you are willing to pay more than what you are behind, you may have a better chance of getting the bank to agree to the terms of the late catch up payment when the bonus comes in.

Mortgage Paperwork

Bring all the documents that you were given from your mortgage company when you closed on the loan. You also want to have your payment records, the bank statements that show the payments came out, and all letters or information you've been given from your mortgage company.

Your lawyer needs this to see the terms and to see how far behind you are with your payments. Your lawyer will also need the paperwork to contact the management at the mortgage company. All threatening letters or notifications need to be brought to your lawyer.

You need to contact a foreclosure lawyer before you get any further behind on the payments and so you can work something out with your lawyer before the bank moves forward and starts the foreclosure process. The lawyer will work hard to work out a deal, and if they can't save the property, you may want to look into bankruptcy options. The lawyer will assess your finances and debt and let you know what will be the best for your current financial struggles and problems.
